Terms of Service

These Terms of Service ("Terms") govern your access to and use of Pitch Master (the "App" or "Service") provided by Analog Studio ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. The Service

Pitch Master is a music training application designed to help users develop pitch recognition and pitch practice skills. The Service may include, now or in the future, level progression, practice and test modes, microphone-based pitch detection, audio playback, and related tools.

We may modify, update, suspend, or discontinue any part of the Service at any time.

2. Eligibility

You may use the Service only if you can form a binding contract with us and are not prohibited from using the Service under applicable law. If you are using the Service on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.

3. Accounts and Access

At present, the App may allow you to use the Service without creating a traditional account. We may use device-based profiles, local storage, or similar functionality to support your experience.

If we later introduce sign-in, account, or profile features, additional terms or requirements may apply. You are responsible for maintaining access to the device and any credentials used to access the Service.

Certain features of the Service require an active paid subscription.

5. Free Trial

The annual subscription may include a 7-day free trial. Unless you cancel before the end of the trial period, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription price.

Free trials are subject to any eligibility rules presented at signup and may be limited to one per user, device, or account, depending on the offer.

6. Billing, Renewal, and Cancellation

Subscriptions are billed through the applicable platform provider or app marketplace where you purchased the subscription. Payment will be charged to the account associated with that platform at confirmation of purchase, after any applicable free trial ends, and at the beginning of each renewal period.

Subscriptions automatically renew unless canceled before the end of the current billing period or trial period. You can manage or cancel your subscription through the subscription settings provided by the applicable platform provider.

If you cancel, you will continue to have access to the paid features until the end of the then-current billing period or trial period, unless otherwise stated in the offer.

Taxes may apply and will be charged as required by law.

7. Refunds

All purchases are subject to the refund and cancellation policies of the applicable platform provider and applicable law. We do not control billing, renewal, cancellation, or refunds processed by the platform provider. If you want a refund, you must request it through the platform provider's refund process.

When you request a refund from Apple, we may provide Apple with information about delivery of the Service, your account and subscription, your use of the App, and the elapsed portion of the applicable subscription period. We may also provide a recommendation to grant or decline the request based on our records. Apple retains sole responsibility for the final refund decision.

8. License

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to download, install, and use the App for your personal, non-commercial use.

Except for the limited rights expressly granted in these Terms, we and our licensors retain all rights, title, and interest in and to the App and its content.

Your use of the Service may involve the collection, storage, and processing of certain information, including profile preferences, usage data, practice progress, session information, microphone input necessary for pitch detection, and notification preferences.

Our collection and use of personal information is described in our Privacy Policy, which should be read together with these Terms. If there is any conflict between these Terms and the Privacy Policy regarding privacy-related matters, the Privacy Policy controls.

You understand that some features may require microphone access and notification permissions. If you deny those permissions, some features may not work properly or at all.

11. Third-Party Services

The Service may rely on third-party services to provide payment processing, app distribution, analytics, notifications, cloud features, or other operational support. Those third-party services are governed by their own terms and privacy policies.

We are not responsible for third-party services outside our reasonable control.

12. Educational Use Only

The App is intended for educational and practice purposes only. The Service is not a substitute for professional music instruction, certification, diagnosis, or any other professional advice or service.

We do not guarantee that use of the App will improve your skill level, performance, or results.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory.

Without limiting the foregoing, we disclaim all warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.

To the fullest extent permitted by law, Analog Studio and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or use, arising out of or related to your use of or inability to use the Service.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the amount you paid to us for the Service in the twelve months preceding the event giving rise to the claim, or, if greater, the minimum amount permitted by applicable law.

You agree to indemnify, defend, and hold harmless Analog Studio and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, abused the Service, engaged in fraud or misconduct, or if necessary to protect the Service, our users, or our rights.

You may stop using the Service at any time. Cancellation of subscriptions must be done through the applicable platform provider.

Sections that by their nature should survive termination will survive, including payment obligations, disclaimers, limitations of liability, indemnification, and any provisions relating to dispute resolution.

17. Changes to These Terms

We may update these Terms from time to time. If we do, we will post the updated Terms or otherwise provide notice as required by law. Your continued use of the Service after the effective date of the updated Terms means that you accept the updated Terms.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of Canada, without regard to conflict of law rules.

Any dispute arising out of or relating to these Terms or the Service will be resolved in the courts located in Canada, unless applicable law requires a different venue or dispute resolution process.

If you want arbitration, class action waiver language, or a small-claims carveout, those should be added here after you choose the governing jurisdiction.
